Terms of Service

1. What the service does

AI Futures Trader computes and displays Market Profile structure for a set of futures markets: TPO profiles, value areas, points of control, initial balance, naked POCs, overnight inventory and gap statistics. It produces a daily written brief, structure alerts, a trade planner that sizes a hypothetical position, and statistics measured over past sessions.

The service does not place, route, modify or cancel orders in your brokerage account. Order routing exists in the platform only as an internal, operator-run capability and is not part of any subscription. The Trade Planner and paper brackets record intentions inside this product; they never reach a broker.

2. Data, accuracy and availability

Market data reaches this service through a broker or data gateway and is subject to that provider's availability, delays, corrections and outages. Profiles are computed from that data, so a gap or error upstream becomes a gap or error here. We publish operational health inside the product rather than claiming continuity we cannot guarantee.

The service is provided as is, without warranty of accuracy, completeness, timeliness or fitness for a particular purpose. We do not warrant uninterrupted or error-free operation.

No service-level agreement or guaranteed uptime applies to Free, Pro or Elite plans.

3. Accounts

You sign in with an email address using a magic link. You are responsible for keeping access to that mailbox, and for everything done through your account. One account is for one person: sharing credentials, or reselling or redistributing the data and analytics the service produces, is not permitted.

The free trial is offered once per person. Deleting your account does not reset trial eligibility, and registering again under a different email or identity to take another trial is a violation of these terms; we may end such a trial or account.

API keys, where your plan includes them, are read-only and rate limited. Treat a key as a credential, because anyone holding it acts as you.

4. Plans, billing and cancellation

Paid plans are billed in USD, monthly or yearly, in advance. Payments are processed securely by Stripe. Any applicable tax is shown during checkout and on the payment receipt.

You can cancel at any time from your account page. Cancelling stops future renewals and keeps your access for the period you have already paid for. It does not end access immediately, and by itself it does not produce a refund. Refunds are covered in the refund policy.

A payment that is not collected, such as an expired card or a failed renewal, may put your plan into a past-due state and then end it. Access follows the state of the subscription and the period you have paid for.

If we change the renewal price for an existing subscription, we will give at least 30 days' notice before the new price is charged. You may cancel before it takes effect.

5. Market data licensing

This matters and is easy to get wrong, so it is stated plainly.

• On Free and Pro, you receive our computed profiles, statistics and levels for your own use, not a redistributable market-data feed. You may not extract, re-publish or resell the underlying data or derived analytics.
• On Elite, the personal-feed capability connects your own broker account, so the data driving your view flows under your account's data entitlement with that broker. Each connection is isolated to its owner and is not reused to supply another subscriber. You are responsible for holding whatever API and market-data subscription your broker requires, and for using it within their terms.

Shared-feed analytics are available only while our use is authorized by the relevant broker, gateway and exchange terms. We may restrict a market, feature, territory or account immediately when those terms require it. Your subscription never transfers any right in the provider's underlying data.

A listed broker or prop firm is a compatibility statement, not a claim that it sponsors, endorses or is affiliated with AI Futures Trader. Provider access can change, and a personal API key does not waive the provider's terms for hosted third-party software.

6. Acceptable use

• Do not scrape, bulk-export or mirror the service outside the documented API and your plan's rate limits.
• Do not attempt to reach data or capabilities your plan does not include.
• Do not present output from this service as your own advisory product to third parties.

We may suspend an account that does these things, or that we are required to suspend by law.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for trading losses, lost profits, lost opportunity, or any indirect or consequential loss arising from your use of the service. That includes cases where data was late, wrong or missing, and cases where the service was unavailable.

To the fullest extent permitted by law, our total aggregate liability arising from the service is limited to the greater of USD 100 or the amount you paid us for the service during the 12 months before the event giving rise to the claim.

Nothing here excludes liability that cannot lawfully be excluded.

8. Changes and termination

We may modify the service and these terms. Material changes will be reflected in the date above. You may stop using the service at any time; you can delete your account and data from the account page.

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Unless mandatory consumer law requires otherwise, disputes must be brought in the state or federal courts serving Cook County, Illinois.
